TERMS & CONDITIONS
The following terminology applies to this Terms and Conditions, Privacy Statement and Disclaimer Notice, and any or all Agreements: “You” and “Your” refers to you, the person accessing this website and accepting Unplug Picnics LLCs Terms and Conditions. “The Company”, “Ourselves”, “We” and “Us”, refers to our Company Unplug Picnics LLC. “Party”, “Parties”, or “Us”, refers to both the Client and us, or either the Client or ourselves. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
In using this website: You are deemed to have read and agreed to the following Terms and Conditions, which may be updated or changed from time to time by Unplug Picnics LLC without notice to You. If You do not agree with any of the Terms and Conditions, do not use this website, our mobile app, or our services. Because our services are evolving over time, we may change or discontinue all or any part of our services, at any time and without notice, at our sole discretion. Your continued use of this website following the posting of any changes to this Terms and Conditions constitutes acceptance of those changes.
USE OF EQUIPMENT
All Equipment supplied on hire is the property of Unplug Picnics.
Any damage, loss or extensive cleaning will result in a fee to The Customer.
Our furniture is very delicate. It requires special handling from our team. The persons hosting the event shall be responsible for any loss or damage to any items such as plates, goblets, ceramic bowls/plates, vases, props and other decorations. Fees will apply for replacement at the full cost of purchasing a replacement. These fees are payable within seven days of such loss or damage unless agreed otherwise.
The Customer shall pay for all equipment damage or loss however caused during that period. Damage includes but is not limited to;
Improper use of equipment
Disappearance of the equipment
Damage to, or loss of, the equipment from any unknown cause
Cigarette burns on any furniture or décor items. Smoking is not permitted on or near the property of Unplug Picnics LLC
Red wine or other staining product spillages or stains on any furniture or décor items
With the exception of battery-powered candles, no candles, fires or other flammable properties are to be lit during the booking.
PAYMENT
All payments are due at booking prior to the event. The event setup will not occur without full payment.
PUNCTUALITY
Please make sure you arrive on time for your event as someone will be waiting upon your arrival. You get the picnic for a total of 3 hours. Your booking time starts at the agreed upon time and not at the time you arrive.
LEAVING EARLY
If you wish to leave earlier than your booking time, please contact us 30 minutes prior. Please do not leave your picnic unattended until our team arrives to clean up, you are responsible for our stuff until we arrive.
CANCELLATION
Notice must be provided no less than 48 hours in advance and the rescheduled date is subject to availability. Please note that if the distance to the new location is significantly further from the original location, additional travel fees may be incurred. There are no cancellation charges for rescheduling your picnic. You have up to 8 months to reschedule.
REFUND POLICY
Unplug Picnics LLC does not offer refunds once payment has been received. If We have cancelled Your Picnic Package for any reason, with less than twelve (12) hours advance notice, we shall refund any payment already received.
Refunds will not be offered in the event of inclement weather as other bookings will have been turned away to service your picnic event. If there’s bad weather in the forecast, we will contact you two days before the picnic and offer you to reschedule, or we will offer a home set up. Travel fees might apply depending on the distance.
BAD WEATHER
We monitor the forecast the day of your picnic, if the chance of rain is too high we will not set out our supplies. Rescheduling due to bad weather is free of charge. We can also move your picnic indoors or on a covered patio per your request.
ALCOHOL CONSUMPTION
It is the responsibility of the customer to check alcohol laws of any venue or public space being used for our pop-up picnics. Most public parks are prohibited from drinking and a fine can be issued. Unplug Picnics LLC takes no responsibility for any alcohol consumption or penalties.
FOOD CONSUMPTION
We are not responsible for any food allergies or any issues or illness caused from foods that were consumed or purchased from third party vendors.
IMAGE RELEASE
In the event that photographs of Your Picnic Package have been taken and shared either on social media or with Us, Unplug Picnics LLC reserves the right to use such photographs in its promotional materials.
LIABILITY
Unplug Picnics LLC shall in no way be held responsible or accountable for any damage, injury, illness, death or loss of income caused to the client, any third parties or properties due to the hire of equipment or provided services by the hire company. All equipment is hired and is the responsibility of the client until returned to the hire company.
FORCE MAJEURE
Unplug Picnics LLC shall not be liable for any failure or delay in delivery or otherwise performing its obligations hereunder with respect to any goods or services being purchased if such failure or delay is caused by a strike, lockout, labor dispute, accident, war, act of terrorism, act of God, fire, flood, or other casualty or cause beyond Unplug Picnics LLCs reasonable control.
